Read this Acknowledgement of Risk and Waiver of Liability carefully and in its entirety. It is a binding legal document.

WAIVER (entry not valid unless electronically signed on your registration page’s signature capture): I know that participating in the Czhilispiel 5K Run Walk is a potentially hazardous activity and I should not enter and participate unless I am medically able and properly trained. I acknowledge and assume any and all risks associated with this event including, but not limited to, traffic on the course route, falls, contact with other participants, contact with animals, including dogs, and the condition of the course, including, but not limited to, curbs, cars, uneven pavement, potholes, rocks, loose footing and objects on the course surface In consideration of this entry, I waive and release any and all claims for myself and my heirs against Czhilispiel, Flatonia Chamber of Commerce, the City of Flatonia, any sponsor and all officials of this race for any injury or illness that may directly or indirectly result from my participation in the Czhilispiel 5K Run/Walk.

I understand this is a rain or shine event with no refunds for any reason, including, but not limited to, weather, traffic, crowds, mobs, equipment or timing failure or a rescheduled event that you are unable to attend. I agree that my non-refundable paid entry may also include other items of value that exceeds my paid entry price. Any deviations from this refund policy, including rescheduling or future event credit, will be at the sole discretion of the Czhilispiel Board of Directors.

I also consent to my photo, and/or video, including the use of a licensed drone operator, being taken and used in future Czhilispiel and Flatonia Chamber of Commerce marketing. Any drone operator will be subject to current State of Texas commercial operator standards, including licensing.


In signing the Acknowledgement of Risk and Waiver Liability I hereby acknowledge and represent: (a) that I have read this document in its entirety, understand it, and sign it voluntarily; and (b) that this Acknowledgement of Risk and Waiver of Liability is the entire agreement between the parties hereto and its terms are contractual and not a mere recital.

REQUIRED FOR ALL PARTICIPANTS UNDER 18 YEARS OF AGE: PARENT OR GUARDIAN’S AUTHORIZATION FOR MEDICAL CARE AND CONSENT AGREEMENT

I certify that I am the parent or legal guardian of the named participant in the ACTIVITY. On behalf of myself and my spouse, partner, co-guardian or any other person who claims the participant as a dependent, I have read the above agreement, I understand the contents of this Acknowledgement of Risk and Waiver of Liability, assent to its terms and conditions, and sign this Acknowledgement of Risk and Waiver of Liability of my own free act. I acknowledge that my dependent and I have agreed to the terms and conditions of my dependent’s participation in the ACTIVITY, and I hereby give my consent to participation by my dependent in the ACTIVITY, and to receive medical treatment determined to be necessary. I further agree to hold harmless, indemnify and defend Czhilispiel, Flatonia Chamber of Commerce, the City of Flatonia, any sponsor and all officials of this race from and against all claims, demands or suits that my dependent has or may have.
